Part 1: Terms
1. Who we are
The Inner Mountain is operated by LDC, PO Box 702, Callander, Ontario P0H 1H0, Canada.
2. Agreement
By accessing or completing the Inner Mountain assessment ("the Assessment"), you agree to these Terms and Conditions, including the Privacy Policy in Part 2. If you don't agree, please don't use the Assessment.
3. Eligibility
You must be at least 18 years old. By using the Assessment, you confirm that you are.
4. What the Assessment is
The Inner Mountain is a self-reflection tool. It offers a general reading of patterns in your inner and relational life, for personal insight and educational purposes.
It is not a psychological, medical, or clinical assessment. It does not diagnose, treat, or replace care from a licensed professional. Nothing in your results is professional advice. If you are in distress or crisis, contact a qualified professional or local emergency services.
5. Your results
Results are generated from your answers and are general in nature. We don't guarantee their accuracy or suitability for any purpose. You are responsible for any decisions you make based on them.
6. Offers and waitlists
Your results may include invitations to programs, services, or waitlists. Joining a waitlist does not guarantee a place. Any paid engagement is governed by its own agreement.
7. Intellectual property
The Assessment, its questions, frameworks, methodology, results text, and branding (including "The Inner Mountain") belong to LDC. You may keep and share your own results for personal, non-commercial use. You may not copy, reproduce, resell, or create derivative works from the Assessment. If you send us feedback, we may use it freely.
8. Acceptable use
You agree not to submit false information about another person, interfere with or attempt unauthorized access to our systems, scrape or copy content, or use the Assessment for any unlawful purpose.
9. Disclaimers and liability
The Assessment is provided "as is." To the maximum extent permitted by law, we make no warranties of any kind, and LDC and its team are not liable for any indirect, incidental, or consequential damages arising from your use of, or reliance on, the Assessment or its results. Nothing in these Terms limits rights you have under applicable consumer protection law.
10. Disputes
If you have a concern, please contact us first at lee@lee-davis.com so we can try to resolve it informally.
These Terms and Conditions are governed by the laws of Ontario and the federal laws of Canada that apply there. Any legal dispute arising from them or from the Assessment will be heard exclusively in the courts of Ontario, and you agree to their jurisdiction.
11. Changes
We may update or discontinue the Assessment, or update these Terms and Conditions, at any time. We'll post the revised version with a new date. Continued use means you accept them.
12. General
If any provision is found unenforceable, the rest remains in effect. We may transfer these Terms and Conditions if our business is sold or restructured. This document is the entire agreement between you and us regarding the Assessment.
Part 2: Privacy Policy
13. Who is responsible
LDC is responsible for the personal information collected through the Assessment. Lee Davis is the person accountable for privacy at LDC. For any privacy question or request, contact lee@lee-davis.com.
14. What we collect
- Information you provide: your answers, name, email, and anything else you choose to submit.
- Information collected automatically: device, browser, IP address, approximate location, and usage data, gathered through cookies, pixels, and similar tools.
- Your results: the reading generated from your answers.
15. How we use it
We use your information to:
- deliver your results and operate the Assessment;
- personalize content and invitations to our programs, services, and waitlists;
- send you emails, where you have opted in;
- improve the Assessment, our content, and our offers;
- measure and run advertising (see Section 18);
- comply with legal obligations and protect our rights.
We only use your information for these purposes, or as otherwise permitted or required by law.
16. Your consent
By checking the consent box and submitting the Assessment, you expressly consent to the collection and use of your answers, results, and contact details as described in this Policy. Marketing emails require your separate opt-in. You can withdraw consent at any time (see Section 24).
17. Automated results
Your results are generated automatically from your answers. They are for self-reflection only and are not used to make any decision that has a legal or similarly significant effect on you.
18. Cookies and advertising
We may use cookies, pixels, and similar tools, including those from Meta and Google, to understand how the Assessment is used and to measure and show relevant ads. Where required by law, we ask for your consent before using non-essential cookies.
We may also share your email address with these platforms in a scrambled (hashed) form so they can show you our ads or find people with similar interests. They use it only to match you to an account on their platform. Your answers and results are never shared this way.
You can limit this through your browser settings and your ad preferences on those platforms.
19. Anonymized data
We may combine responses into anonymized, aggregated data. Your name, email, and any other details that could identify you are removed first, so the data cannot reasonably be linked back to you.
We may use this anonymized data for research, publications, and developing our programs and content, and we may share, license, or sell it to third parties. Anonymized data is not personal information and is owned by LDC.
20. Sharing
We do not sell or share information that identifies you with third parties for their own purposes. We share it only:
- with service providers who help us run the Assessment (such as hosting, email, analytics, and advertising), under confidentiality obligations;
- with advertising platforms, as described in Section 18;
- where required by law;
- as part of a sale or transfer of our business, with the same protections applied.
21. Storage and security
Your information is kept on secure systems, with access limited to those who need it to run the Assessment. It is stored and processed by our service providers, who may be located outside your country, including outside Canada, where it may be subject to local laws. No system is completely secure, but we take reasonable steps to protect your information. If a breach affects your information, we will notify you and the relevant authorities as required by law.
22. Retention
We keep your information only as long as needed for the purposes above, then delete or anonymize it. You can ask us to delete it sooner.
23. Age
The Assessment is not intended for anyone under 18, and we do not knowingly collect their information.
24. Your rights
- You can unsubscribe from emails at any time using the link in any email.
- You may request access to, correction of, or deletion of your personal information, or withdraw consent, by contacting lee@lee-davis.com. We'll respond within 30 days.
- If you have concerns about how we handle your information, you may contact the Office of the Privacy Commissioner of Canada.
25. International users
The Assessment is available worldwide. If you are outside Canada, including in the European Union or United Kingdom:
- Legal basis: we process your information to deliver your results, with your consent (for your answers, emails, and non-essential cookies), and for our legitimate interest in operating and improving the Assessment.
- Additional rights: you may also request a copy of your data in a portable format, and object to or ask us to restrict how we use it.
- Transfers: your information is stored and processed by our service providers, who may be located in Canada, the United States, or other countries. Where required, we use appropriate safeguards for these transfers, such as standard contractual clauses.
- Complaints: you may contact the privacy regulator where you live.
26. Changes to this Policy
We may update this Policy. We'll post the revised version with a new date.
